The traffic stop was legal on the basis of an expired registration. That’s the first thing you need to know. In this case, the police claimed they smelled marijuana in the vehicle and on that basis, executed a search of the vehicle and its passengers. Strangely, however, marijuana was not mentioned in the arrest report. Police recovered a bag of oxys and $75,000 in cash. So, where was the marijuana they smelled? Since the marijuana smell was the basis for conducting a search of the vehicle (a registration violation is not cause to search a vehicle), you would expect them to find marijuana in the vehicle or evidence that the driver was under the influence at the time. There does not appear to be any of that, so it’s more than likely the legal team for Mr. Black will choose to fight the search and seizure of the vehicle on the basis of the phantom marijuana smell.

On the other hand, Mr. Black has a history of being charged with dumb crimes. Not only did he lie on a federal application for a firearms license, he was also caught with an illegal weapon on the U.S. and Canadian border. That’s the last place you want to bring your weapon. Black also pleaded guilty to a sexual assault charge involving a teenager.

It can be difficult for defendants to establish that a search was illegal on the basis of a phony pretense. However, the lack of marijuana discovered in the vehicle and the fact that the car was pulled over due to a registration violation will likely become the centerpiece of Mr. Black’s defense.
