Can Prosecutors Use Your Recorded Jail Phone Calls Against You in Florida?

JailCall

One of the first things you might do after being arrested is contact a family member or close friend. This can include providing some explanation of the situation, seeking assistance from someone else, or even having someone to talk to about it all. Yet, making such discussion of your criminal case on a jail phone call could lead to very serious troubles for your defense.

Jail phone calls in Florida are frequently recorded. The prosecution could acquire those recordings and make attempts to use your statements against you in court if proper conditions apply.

Jail phone calls are usually not private

Those detained in Florida jails should not expect any confidentiality on phone calls. Most jail phone systems warn of monitoring or recording the call.

However, your conversations with your attorney are privileged. Communication between attorney and defendant cannot be used against you during your case in most situations, but the defendant should still follow their attorney’s instructions regarding how to do this properly.

Third parties such as friends, family members, and romantic partners don’t enjoy such privilege.

How can a jail call harm your criminal case?

It is not necessary for the accused to give a confession for the jail phone recording to be considered valuable for the prosecution. Sometimes even minor statements can become very important depending on the overall context of the conversation.

For instance, the accused could tell the other side about their whereabouts at a certain point in time. Your contact may also mention knowledge about someone else involved in the case, a verbal altercation, or anything that contradicts information they gave later to officials.

Even statements made in a funny manner or without full context may look different when played before a judge or the jury members.

Can prosecutors introduce the conversation at trial?

Possibly. Florida’s rules of admissibility typically allow your statements to be admitted against you when the evidentiary criteria are met.

This does not mean that all jail recordings will automatically be admitted as evidence. An attorney for the defendant can look into matters such as the authenticity, relevance, hearsay, or other matters related to statements made by third parties. Any information they can use against you will be considered.

How the recording was made may also be relevant to the case.

What should you say during a jail phone call?

As little as possible. You want to inform your contact that you’re in jail, why, that you can’t say much about it, but not much more. Do not discuss the facts of your case. Don’t explain what happened. Don’t discuss evidence. Don’t discuss your defense strategy. Instead, save this conversation for your attorney.
